Definition

Legal issues related to an employee’s right to privacy in the workplace. This includes concerns about employer monitoring, searches, access to personal information, medical confidentiality, and surveillance. This issue covers situations where an employee believes their employer has improperly monitored communications, searched personal belongings, accessed private accounts, disclosed medical information, or installed surveillance without proper notice. Questions often arise about privacy in emails, text messages, social media, personal devices used for work, locker or desk searches, drug testing, background checks, and workplace cameras. It also includes understanding the limits of workplace privacy protections, which may depend on employer policies, whether equipment is employer-owned, consent forms, union agreements, and federal or state laws. Legal questions may involve data protection rules, confidentiality of personnel files, medical privacy laws, and protections against intrusive or discriminatory practices. Privacy rights at work vary significantly by jurisdiction and by the nature of the workplace.
